1. Scope
These General Terms and Conditions apply to all orders, deliveries, services, and business relationships concluded via the online shop alwerk.at between Aslan Lalaev (hereinafter referred to as the “Seller”) and consumers as well as entrepreneurs (hereinafter referred to as the “Customer”). The version valid at the time of the order shall apply.
Any deviating conditions of the Customer shall not be recognized unless expressly agreed to in writing.
2. Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer but rather a non-binding online catalog. By clicking the order button (e.g., “Order with obligation to pay”), the Customer submits a binding offer to purchase the goods contained in the shopping cart.
The purchase contract is only concluded through an explicit order confirmation by email or by shipment of the goods. The mere confirmation of receipt of the order does not yet constitute acceptance of the contract.
The Seller is entitled to reject orders without stating reasons, particularly in cases of suspected fraud, technical errors, or delivery problems.
3. Customer Account
Customers may voluntarily create a customer account.
Login credentials must be kept confidential. The Customer is liable for misuse of their account if such misuse is attributable to them. Negligent disclosure of login credentials to third parties shall in any case constitute misuse.
4. Prices and Payment Terms
All prices are stated in Euros as final prices.
The following payment methods are offered by the Seller:
· PayPal
· Stripe (credit card, etc.)
· Klarna
The terms and conditions of the respective payment service providers shall additionally apply.
5. Delivery and Shipping
Delivery is available within Austria, Germany, and Switzerland. Delivery times depend on the product and are specified in the shop for each item.
Delays due to force majeure, supply shortages, or customs clearance do not entitle the Customer to claim damages unless the Seller acted intentionally or with gross negligence.
6. Retention of Title
The goods remain the property of the Seller until full payment has been received.
7. Right of Withdrawal for Consumers
Consumers are entitled to a statutory right of withdrawal. Detailed conditions and the sample withdrawal form can be found in the separate withdrawal policy.
8. Returns and Refunds
Returns must be properly packaged and, if possible, returned in their original packaging.
To the extent permitted by law, the Customer bears the direct costs of returning the goods.
Refunds will be issued after receipt and inspection of the returned goods.
9. Warranty
The statutory warranty rights under Austrian law shall apply.
For entrepreneurs, the warranty period is 12 months from delivery of the goods. The provisions of Section 377 of the Austrian Commercial Code (UGB) regarding the obligation to inspect and notify defects remain unaffected.
Claims for damages due to personal injury as well as intent or gross negligence remain unaffected by this limitation period.
10. Liability
The Seller shall only be liable in cases of intent and gross negligence.
In particular, no liability shall be accepted for:
· improper installation
· faulty installation
· incompatibility due to incorrect vehicle data
· consequential damages caused by improper use
Safety-relevant products may only be installed professionally.
11. Product Information and Compatibility
Product specifications, dimensions, vehicle compatibilities, and technical data are provided to the best of our knowledge.
No warranty or guarantee is assumed for absolute compatibility, especially if the Customer provides incomplete or incorrect vehicle information.
12. Vouchers and Discount Campaigns
Vouchers may be subject to conditions, including:
· non-combinability
· no cash redemption
· limited validity
· other conditions disclosed transparently in advance
13. Applicable Law and Jurisdiction
Austrian law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
The place of jurisdiction for entrepreneurs shall be the Seller’s registered office.
14. Severability Clause
1. Should individual provisions of this contract be wholly or partially invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
2. In place of the invalid or unenforceable provision, a legally permissible provision shall be deemed agreed upon that comes closest to the economic purpose of the invalid or unenforceable provision and that the Seller would reasonably have chosen had they been aware of the invalidity or unenforceability.
3. In the event of a contractual gap, the provision shall be deemed agreed upon that corresponds to what would have been agreed according to the meaning and purpose of this contract and the presumed intent of the Seller if the matter had been considered from the outset.
Withdrawal Policy: Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period shall be fourteen days from the day on which you or a third party designated by you, who is not the carrier, took possession of the goods.

by means of a clear declaration (e.g., a letter sent by post or an email) of your decision to withdraw from this contract. You may use the attached sample withdrawal form, although this is not mandatory.
To meet the withdrawal deadline, it is sufficient that you send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.
Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including delivery costs (except for additional costs arising from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we received notification of your withdrawal from this contract.
For this reimbursement, we will use the same means of payment that you used for the original transaction unless expressly agreed otherwise with you. In no event will you be charged any fees for this reimbursement.
We may withhold reimbursement until we have received the returned goods or until you have provided proof that you have returned the goods, whichever occurs first.
You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you informed us of the withdrawal from this contract. The deadline is met if you dispatch the goods before the period of fourteen days has expired.
You shall bear the direct costs of returning the goods.
You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
